Welcome to TheMediator.AI (the “App”). By opening an account, starting a dispute, or using any part of our website, mobile apps, or related services (collectively, the “Services”), you agree to these Terms of Service (“Terms”). If you don’t accept them, please don’t use the Services.
1. Who we are
TheMediator.AI is owned and operated by Underlabs Inc., 2001 Boulevard Robert-Bourassa, Montréal, Québec, Canada (“we,” “us,” “our”).
2. What we do
We provide an AI-powered platform that helps two people work through everyday conflicts—roommate tensions, co-parenting schedule spats, neighbor noise issues, and similar personal disputes. Our system:
Collects each party’s story privately.
Generates an impartial summary and guided questions.
Suggests a possible resolution.
Lets parties export a PDF record.
Important: TheMediator.AI is not a court, law firm, lawyer, or emergency service. The AI facilitator is not a licensed human mediator. Resolutions created here are non-binding unless all parties choose to sign a separate agreement under their local law.
3. Who can use the Services
You must be at least 18 years old (or the age of legal majority where you live).
You must have the legal right and mental capacity to enter into these Terms.
You must only provide information that is accurate, current, and your own.
4. Fees & billing
The first dispute per phone number is free.
After that, starting a dispute costs USD $4.99 (plus any taxes) and is charged through the applicable app store before or when the mediation is initiated, depending on the app flow.
App-store-level refunds follow Apple App Store / Google Play rules.
5. Privacy & security
We store only the data needed to run the mediation.
Personal data is encrypted in transit and at rest.
Unless the law says otherwise, all dispute data is permanently deleted 30 days after an attempted outcome is generated or when any party deletes the dispute sooner.

6. Your responsibilities
You agree to:
Use the Services only for lawful purposes.
Treat the other party respectfully.
Provide honest answers to our questions.
Not upload or share content that is illegal, hateful, harassing, or that infringes anyone’s rights.
Keep login credentials secure; you’re responsible for activity under your account.
7. Prohibited uses
You may not:
Attempt to reverse-engineer our software or AI models.
Send viruses, malware, or abusive code.
Use the Services to negotiate criminal activity or violence.
Harvest or scrape any personal data from other users.
Impersonate another person or entity.
8. Intellectual property
All software, text, graphics, and trademarks in the Services belong to us or our licensors.
You keep ownership of the content you submit but grant us a non-exclusive, royalty-free license to use it solely to operate the Services.
9. Feedback
If you send suggestions or ideas, you allow us to use them without any obligation to you.
10. Service changes & availability
We may update, suspend, or discontinue the Services (or any part of them) at any time and without liability. We’ll try to give notice when practical.
11. Disclaimer of warranties
The Services are provided “as is” and “as available.” To the maximum extent allowed by law:
We make no warranties that the Services will be uninterrupted, error-free, or achieve any particular outcome.
We disclaim any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
The App is not a substitute for professional legal advice, mental health counseling, or emergency services.
12. Limitation of liability
To the fullest extent permitted by law, Underlabs Inc. and its officers, directors, employees, or partners will not be liable for:
indirect, incidental, consequential, punitive, or special damages,
lost profits, revenues, or data, or
any claim exceeding the greater of USD $50 or the amount you paid us in the past 12 months.
13. Indemnity
You agree to defend and indemnify us against any third-party claim arising from:
your breach of these Terms,
your misuse of the Services, or
your violation of another person’s rights.
14. Suspension & termination
We may suspend or close your account if you breach these Terms or use the Services in a way that risks harm to us or others. You can delete your account at any time inside the app.
15. Governing law & venue
These Terms are governed by the laws of Québec, Canada and applicable federal Canadian law, without regard to conflict-of-laws rules.
16. Dispute resolution between you and us
Before filing any lawsuit, you agree to first email [email protected] with a concise description of your complaint and give us 30 days to work it out informally.
If we can’t settle:
Binding arbitration administered by the International Centre for Dispute Resolution (ICDR) will decide, on an individual basis.
Venue will be Montréal, Canada, unless both sides agree to virtual hearings.
Either party may bring qualifying claims in small-claims court instead.
Class actions are waived—each side may bring claims only in its individual capacity.
Users located in the EU/UK may invoke the EU ODR platform.
17. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced in-app or by email. Continued use after the effective date means you accept the new Terms.
18. Severability
If any part of these Terms is held unenforceable, the rest remains in full force.
19. Entire agreement
These Terms (plus the incorporated Privacy Policy) make up the complete agreement between you and us and supersede any prior understandings.
